Southern Ute Tribe - Air Quality Program Development
|
Air Sciences continues to work with the Southern Ute
Indian Tribe to develop one of the more sophisticated
and unique Air Quality Programs in Indian Country. From
building essential technical tools (emissions inventories,
Operating Permit training) to helping to frame unique
inter-governmental cooperation with the State of Colorado,
Air Sciences has worked hand-in-hand with the Tribe.
Some key aspects of the Southern Ute Air Quality Program
are:

- Preparation of a Feasibility Study for an Operating Permit
Program. This assessment prepared by Air Sciences demonstrated
that the number of major stationary sources (as defined
by the Operating Permit Regulation in 40 CFR Part 70) and
the quantity of regulated pollutants (criteria pollutants
and hazardous air pollutants) were sufficient to justify
a self-sustaining operating permit program delegated to
the Tribe under 40 CFR Part 70.
- Creation of the Southern Ute Tribe/State of Colorado Joint
Environmental Commission. Due to unique jurisdictional issues,
the Tribe and State worked together for many months to craft
an agreement that would allow for the smooth transition
of permitting authority to the Southern Ute Tribe. Currently,
the Tribe and Air Sciences are working with the Joint Environmental
Commission to prepare the necessary documents for the Tribe
to apply to the US EPA for delegation of an operating permit
program under 40 CFR Part 70.
